To use the Service, you may be required to provide contact and business information. You are responsible for maintaining the confidentiality of any account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use of your account.

4. Acceptable Use

5. SMS Messaging and Telephone Communications

By using the Service and providing a phone number, you consent to receive automated text messages and calls from Neo, At Your Service in connection with your account and service requests. You represent that you have obtained all necessary consents from any end users whose phone numbers you provide to the Service, as required by applicable law, including the Telephone Consumer Protection Act (TCPA).

You are solely responsible for ensuring that your use of the Service complies with all applicable laws governing telephone and text message communications. We reserve the right to suspend or terminate your access if we determine that your use violates applicable law or our policies.

6. Fees and Payment

Fees for the Service, if applicable, will be disclosed to you prior to your subscription or purchase. You agree to pay all applicable fees in accordance with the billing terms presented at the time of sign-up. We reserve the right to change our pricing with reasonable notice.

7. Intellectual Property

All content, software, and materials on the Neo, At Your Service website and Service are owned by or licensed to ClearLine Answering Services LLC and are protected by applicable intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from any part of the Service without our prior written consent.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

9. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, CLEARLINE BUSINESS SOLUTIONS LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING UNDER THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE THREE MONTHS PRECEDING THE CLAIM.

10. Indemnification

You agree to indemnify, defend, and hold harmless ClearLine Answering Services LLC and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Service, your violation of these Terms, or your violation of any applicable law or the rights of a third party.

We reserve the right to suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. You may stop using the Service at any time. Provisions of these Terms that by their nature should survive termination will survive, including but not limited to Sections 7, 8, 9, and 10.

These Terms are governed by the laws of the state in which ClearLine Answering Services LLC is registered, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved in the courts of that jurisdiction.
