1. Introduction

Welcome to Neo At Your Service ("Neo," "we," "our," or "us"). These Terms of Service ("Terms") govern your use of our AI-powered answering service. By signing up for or using Neo, you agree to be bound by these Terms. If you do not agree to these Terms, do not use our services.

2. Description of Services

Neo provides an AI-powered phone answering service that:

• Answers incoming calls to your business phone number 24/7
• Filters spam calls and messages
• Handles customer inquiries professionally
• Provides bilingual support (English and Spanish)
• Captures leads and takes messages
• Handles appointment requests
• Delivers call summaries, messages, and SMS follow-up via SMS and email

3. Billing and Refunds

Subscription Billing

Neo operates on a monthly subscription basis. Your subscription automatically renews on the same day each month until canceled. Founders pricing is $59/mo, locked forever for the first 100 customers, plus $0.30 per minute for legitimate calls handled by Neo. Once Founders allocation is exhausted, public pricing applies at $99/mo plus $0.35 per minute.

Setup Fees

There is no setup fee for Founders customers. A setup fee may apply to public-pricing customers; if so, the fee will be disclosed at checkout before any charge is made.

Cancellation Policy

You may cancel your Neo subscription at any time through the Stripe Customer Portal or by contacting support@neoatyourservice.com. Cancellation takes effect at the end of your current billing period. You will retain access to Neo services until the end of your paid period.

30-Day Money-Back Guarantee

New Neo customers may request a full refund of their monthly subscription fee within 30 days of their initial subscription by emailing support@neoatyourservice.com. After the 30-day window, monthly subscription payments are non-refundable.

Per-minute usage charges are not eligible for refunds, including under the 30-day money-back guarantee. Once a billed call has been completed, the per-minute charge stands.

If you cancel without invoking the money-back guarantee, you will not receive a refund for the current billing period, but your service will continue until the period ends.

Billing Disputes

If you believe you have been charged in error, please contact support@neoatyourservice.com within 30 days of the charge. We will review all billing disputes in good faith.

4. SMS Notifications

By subscribing to Neo At Your Service, you consent to receive SMS text messages containing links to call recordings and transcripts. These messages are sent automatically after each inbound call to your Neo phone number.

• Message Frequency: Varies based on call volume
• Message & Data Rates: May apply per your carrier
• Opt-Out: Reply STOP to any message to unsubscribe
• Opt-In: Reply START to any message to resubscribe
• Help: Reply HELP for assistance

Opting out of SMS does not cancel your Neo subscription. Call recordings remain accessible via your account dashboard and email notifications.

5. Spam Filtering and Billing

Neo actively filters spam calls and messages before they become billable. Spam calls are identified through behavioral detection and are blocked or ended automatically.

You are never charged for spam. Only legitimate calls where Neo engages with a real caller count toward your usage minutes. Spam calls and spam text messages do not count.

While our spam prevention is approximately 99% effective, occasional spam may pass through due to constantly evolving spam techniques. Even when spam is not detected, it is still not billed.

6. Acceptable Use

You agree to use Neo only for lawful business purposes. You may not use Neo to:

• Engage in illegal activities
• Harass, threaten, or abuse others
• Transmit spam or unsolicited communications
• Violate any applicable laws or regulations
• Impersonate another person or entity

7. Data and Privacy

Neo collects and processes call data, including call recordings, transcripts, and caller information, to provide our services. Our use of your data is governed by our Privacy Policy.

You are responsible for ensuring that your use of Neo complies with all applicable privacy laws and regulations, including obtaining any necessary consent from your customers for call recording.

8. Service Availability

We strive to provide 24/7 service availability. However, we do not guarantee uninterrupted or error-free service. Neo may be temporarily unavailable due to:

• Scheduled maintenance
• System upgrades
• Technical difficulties
• Circumstances beyond our reasonable control

9. Limitation of Liability

To the maximum extent permitted by law, Neo At Your Service and ClearLine Answering Services LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Loss of profits or revenue
• Loss of business opportunities
• Missed calls or messages
• Data loss
• Service interruptions

Our total liability to you for any claims arising from or related to these Terms or our services shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.

10. Intellectual Property

All intellectual property rights in Neo, including but not limited to software, technology, branding, and content, are owned by ClearLine Answering Services LLC. You are granted a limited, non-exclusive, non-transferable license to use our services for your business purposes only.

11. Termination

We reserve the right to suspend or terminate your access to Neo at any time, with or without cause, including but not limited to:

• Violation of these Terms
• Non-payment of fees
• Fraudulent or abusive use of our services
• Any conduct that we determine, in our sole discretion, is harmful to our business or other users

Upon termination, you will lose access to all recordings, transcripts, and other data stored in your account. We are not responsible for preserving such data after termination.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by email or through the Neo service. Your continued use of Neo after such changes constitutes your acceptance of the new Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Arizona, United States, without regard to its conflict of law provisions. Any disputes arising from these Terms or our services shall be resolved in the courts located in Maricopa County, Arizona.
